Vision Statement of the Mining Heritage Alliance
Mining has played and continues to play an important role in the history, culure and economy of Utah. The Mining Heritage Alliance, focusing on the past, present and futre of mining, provides residentsand visitors with opportunities to experience the mining industry in anentertaining and engaging way.

There is hereby created the Mining Heritage Alliance (MHA), a coalition and association of private industry, federal, state and local agencies, non-profit organizations, and communites. The MHA seeks to link tourism, recreation, education, and the environment through promoting, preserving, and interpreting Utah's mining industry and heritage. The goal of MHA is to insure that residents and visitors experience mining in a repsonsible, educational, and engaging way.

The MHA is actively involved in the identification, documentation, preservation, and development of Utah's mining resources, be they natural, cultural or historic. Mining resources include the man-made resources, technology, artifacts, oral histories, photographs, and folkways, as well as land forms. It is intended that these resources will be authentically interpreted, using the best technology, to help people better understand the mining heritage in Utah from pre-history to the present. The MHA is also actively involved in the devolopment of mining resource sites and the development of mining heritage tourism.

The MHA's activities and projects are designed to be self-sustaining and to positively impact a variety of areas, people, and organizations--quality educational material and programs will be produced and distributed, mining heritage resources will be developed and preserved, mining heritage tourism will be developed, and communities and companies will experience economic development and growth.

This development of Utah's mining heritage will include many participants working toward the goal of enhancing the public's understanding and appreciation of the contribution and history of Utah mining. Developing and sharing this rich legacy, for the benefit of the people of Utah, its visitors, and the mining industry, in order to improve the economic and cultural quality of life in this State, is the main goal of the Mining Heritage Alliance.

In accomplishing these goals, the Mining Heritage Alliance shall:

Develop and accomplish Mining Heritage Alliance purposes and projects, including common educational materials, common signage, and linking of sites and projects throughout the State;

Assist members in their mining heritage projects;
Bring members, their expertise, and their authority to the accomplishment of mining heritage projects;

Be an advocate for mining heritage tourism and mining heritage projects, as well as the purposes of the Alliance;

Provide a forum for projects and issues in the mining heritage industry;

Enhance, assist in finding funding sources, and add value to mining heritage projects and programs throughout the State.

MEMBERS:

Members shall be public members, private members, and non-profit members. Public members include state agencies, political subdivisions of the state and federal agencies. Private members consist of companies and corporations in mining and tourism industries. Non-profit members consist of non-profit corporations and foundations interested in the mining and/or heritage tourism industry.

OPERATIONS:

The Alliance shall operate through three types of committees:

(A) Committee of the Whole. The members shall meet quarterly as a Committee of the Whole in an open meeting where all members may attend. The agenda shall include a report on the status of any and all projects, proposals from members for new projects, and an ongoing assessment of the Mining Heirtage Alliance and its goals.

(B) The Executive Committee. The Executive Committee shall consist of a smaller number of members to act as the executive, day-to-day authority of the Alliance, subject to the Committee of the Whole. The Executive Committee shall meet monthly, or as needed, to initiate and develop MHA projects and to assist members with their projects. The Executive Committee shall also establish and define working groups of members as needed.

(C) Working Groups. Working groups shall be of two types: standing and project specific groups. Working groups may be established by the Executive Committee or the Committee of the Whole to develop issues, strategies or projects on an on-going basis (standing work group), or to assist and develop individual projects on behalf of the Alliance (project specific groups).

FUNDING:

The Mining Heritage Alliance is authorized to receive money from any member or from any other source, including the Mining Heritage Alliance Association, in order to assist in carrying out its purposes, its projects, as well as the projects of its members. Mining Heritage Alliance is also authorized to develop products and services and may, on an appropriate basis, charge and receive fees and/or costs for said products or services. The Mining Heritage Alliance is also authorized to seek, on behalf of its self or its members, grants from public and private entities to accomplish the purposes of the Alliance or the projects of its members.

THE AGREEMENT:

By signing, each member agrees to the principles and vision of the Mining Heritage Alliance and agrees to cooperate and assist the Alliance in the accomplishment of its purposes, projects and goals. Each member agrees, as determined appropriate by that member, to provide its knowledge, experience, and authority and to add value and broaden the projects of the MHA in accordance with the purposes of the Alliance.

By signing, the members agree that this does not create a "legal" partnership and does not authorize any member to act on behalf of or legally bind any other member, without the express agreement of that member. Any participation, including funding, is on a voluntary basis only and no member is obligated to provide any funding or other assistance without express approval. Any member may withdraw from the Alliance at any time. New members may be admitted at any time, by their executing this document and agreeing to the principles and visions of the Alliance.

The rights and benefits conferred by this Agreement are subject to the law of the United States and the State of Utah governing the public agencies involved, and to the rules and regulations promulgated thereunder, and the mention of specific restrictions, conditions, and stipulations shall not be construed as in anyway impairing the general powers of supervision, regulation, and control of the agencies. The member of our delegate to Congress, or resident Commision shall obtain any share or part of this Agreement or any benefit that may arise thereunder.

Members further agree that all the Alliances activities and projects shall be conducted in accordance with applicable laws, regulations, and general provisions of the United States and the State of Utah, specifically, the Alliance shall comply with the requirements of Executive Order number 11246 of September 24, 1967, as amended, which prohibits discrimination on the basis of sex; 45 C.F.R. 90 which prohibits discrimination of age; and section 504 of the Rehabilitation act of 1973, or the Americans with Disablity Act of 1990, PB. L. 101-336, July 26, 1990, 104 Stat. 227, PB. L. 102, 166, November 21, 1991, 105 stat. 1077, 1095 (ADAM), which require contractors and cooperators to take affirmative action to employ in advance employment, and to advance in the employemnt of qualified handicapped individuals, Title VI of the Civil Rights Act of 1964 and all requirements imposed by or pursuant to the Regulations thereunder, 41 U.S.C.701 Drug Free Work Place Act of 1988, which requires cooperators to prohibit use of drugs in the work place and establish drug free awareness programs, as well as provisions of the Utah Civil Rights Act, Utah Code Ann. 13-7-1 et seq., which prohibits the denial of full and equal accommodations, advantages, facilities, privileges, goods and services on the basis of race, color, sex, relilgion, ancestry and national origin, the Utah Anti-discrimination Act, Utah Code Ann.34-35-1 et seq., which prohibits discrimination in employment matters based upon race, color, sex, pregnancy, child birth, pregnancy rate conditions, age (if the person is 40 years or older), religion, national origin and handicapped, and the provisions of the Utah Executive Order dated June 30, 1989 which prohibits sexual harassment in the work place.
